L'Autrice, dopo aver ripercorso il tema cruciale del rapporto tra professionalità e teoria generale del contratto di lavoro, si concentra sull’analisi del ruolo che il nuovo art. 2103 c.c. assegna alla contrattazione collettiva, rimarcando come la novella del c.d. Jobs Act solleciti un adeguamento del sistema di inquadramento dei lavoratori, ai fini di un legittimo esercizio dello jus variandi. In questa direzione, l’A. assegna un ruolo centrale anche alla contrattazione collettiva di secondo livello, la quale ad esempio è chiamata ad adeguare le previsioni del contratto nazionale alle specificità del contesto aziendale.

The Author, after having reviewed the crucial theme of the relationship between professionality and general theory of the employment contract, focuses on the analysis of the role that the new art. 2103 of the Italian Civil Code assigns to collective bargaining, emphasizing that the new disposition introduced by the so called "Jobs Act" calls for an adaptation of the worker classification system, for the purposes of a legitimate exercise of the jus variandi. In this direction, the A. also assigns a central role to decentralized collective bargaining, which for example is called to adapt the provisions of the national contract to the specificity of the company context.
