Le nuove tecnologie della informazione e comunicazione hanno avuto un forte impatto nella cultura, negli usi e nelle prassi contemporanee. I loro effetti sui rapporti di lavoro hanno ampliato il terreno di confronto tra imprese e lavoratori, producendo un nuovo dibattito a partire dall’inserimento di strumenti di alta tecnologia nella prestazione subordinata di lavoro. Gli attuali spazi digitali (posta elettronica, chat, pagine web, social network, ecc.) e gli strumenti digitali (cellulari, videocamere, laptop, localizzatori GPS, ecc.) potenziano il potere di direzione in ambito lavorativo e riducono tutele consolidate del lavoratore. I sindacati guardano con apparente disinteresse all’uso delle nuove tecnologie da parte dei datori di lavoro, mentre lo Stato, attraverso l’Agenzia di governo elettronico e società dell’informazione (AGESIC), spesso privilegia i diritti della proprietà rispetto ai diritti di intimità e privacy del lavoratore.


JUAN RASO DELGUE The Employment Relationship in the Digital Era

Information and Communication Technologies (ICTs) have had a major impact on individual habits and lifestyles, for instance by changing the way the employment relationship is conceived. ICTs give employers and employees more room for cooperation, concurrently fuelling the debate concerning the use of technology at work. The IT tools currently in place (e-mails, chats, webpages, and social networks) and other digital devices (mobiles, cameras, laptops and GPSs) increase the employer’s control power, while undermining workers’ long-established safeguards. Trade unions seem to agree with employers on the recourse to workplace technologies, while the Uruguayan government has established the E-Government and an Information Society and Knowledge (AGESIC). However, this general concern about the use of ITCs at work has led policy-makers to prioritise property rights, overlooking employees’ right to privacy.
