Franco Carinci Jobs Act, atto I: la legge n. 78/2014 fra passato e futuro


Il d.l. n. 34/2014, convertito in l. n. 78/2014, rappresenta una tappa di quella lunga marcia legislativa costretta a conciliare con la normativa comunitaria la crescente fiducia nella resa occupazionale della flessibilità in entrata. Privilegiando la prospettiva storica evolutiva, si analizza la nuova disciplina del contratto a termine, la cui difficoltà ermeneutica è dovuta in parte all’aver ereditato la tecnica di novellare “a spizzichi e bocconi” testi legislativi concepiti e nati con un loro equilibrio interno, se pur compromissorio, senza farsi carico del necessario coordinamento fra vecchio e nuovo; ed in parte all’aver voluto dare l’impressione di una, sia pur relativa, continuità all’insegna di quel comma 01 dell’art. 1, d.lgs. n. 368/2001, debitamente conservato, che consacra il contratto di lavoro subordinato come «forma comune di rapporto di lavoro». Si accenna, infine, alle modifiche introdotte alla disciplina della somministrazione di lavoro a termine e dell’apprendistato, atteso che, secondo un modulo ormai scontato, un intervento sul d.lgs. n. 368/2001 si porta quasi sempre dietro un qualche innesto al d.lgs. n. 276/2003 e al d.lgs. n. 167/2011, a conferma del carattere fungibile sul mercato del lavoro tra queste tipologie contrattuali e il contratto a termine.

The conversion of Decree Law No. 34/2014 into Act no. 78/2014 is a step in the legal process that has to create a point of equilibrium between the harmonization with Community law and the initiatives at a national level concerning flexibility in dismissal that are thought to promote employment. Taking these considerations as a starting point, this paper examines the new regulation of fixed-term employment contracts through an historical and evolutionary perspective. Two main reasons are given to explain the struggle to govern this form of employment. On the one hand, lawmaking occurred through a piecemeal approach, without ensuring coordination between new and old legislation. On the other hand, lawmakers were mainly preoccupied with providing some form of continuity with par. 1, Article 1 of Legislative Decree No. 368/2001, which regards salaried employment as the “most widespread form of employment”. The concluding part of the paper examines the amendments made to the regulation of temporary agency work and apprenticeships. In this sense, it is usually the case that any intervention made to Legislative Decree No. 368/2011 always contains elements of Legislative Decree No. 276/2003, an aspect that emphasizes the interchangeable nature of the foregoing contractual arrangements and fixed-term employment contracts in the labour market.
