Marco Lai Una “norma di sistema” per contrattazione e rappresentanza

Il contributo, preso atto del declino di sistemi stabili di relazioni industriali in Italia ed in Europa, dopo uno schematico esame dell’evoluzione del rapporto legge, contrattazione, rappresentanza nel nostro Paese, si concentra sull’art. 51 del d.lgs. n. 81/2015 – norma di rinvio ai contratti collettivi – per verificare la possibilità di utilizzare tale previsione quale “norma di sistema” per più ordinate ed affidabili relazioni industriali. La specificazione della nozione di “sindacato comparativamente più rappresentativo”, sia sul versante della rappresentanza dei lavoratori che su quello datoriale, nei termini precisati dalla giurisprudenza, in attesa di un’improbabile riforma organica, potrebbe consentire di utilizzare in chiave riformatrice la contrattazione collettiva e di orientarla verso obiettivi di rilancio della produttività e della competitività.


Marco Lai A “systematic regulation” for collective bargaining and representation

The contribution reflects on art. 51 of the Legislative Decree no. 81/2015 (regulation that refers to collective agreements), by considering the possibility of the use of this regulation as a systematic rule, useful for better organized and reliable industrial relations. The article considers the decline of stable industrial relations in Italy and Europe and briefly analyses the historical evolution of the relationship between the law, collective bargaining and representation in our country (Italy). Emphasis is drawn on the specific reference to the notion of a ‘comparatively most representative union’, as understood in case law and utilised for workers and employers’ associations respectively. Said norm, while waiting the unlikely intervention of a comprehensive organic reform, could entail the use of collective bargaining as a reformative instrument to sustain and achieve objectives relating to productivity and competitiveness.
