Guido Canavesi La specialità degli ammortizzatori sociali “emergenza Covid-19”: intervento emergenziale o nuovo modello di tutela?
Obiettivi: Il saggio analizza gli ammortizzatori sociali in costanza di lavoro al fine di individuarne i tratti strutturali e, in prospettiva futura, le potenzialità “riformatrici” Metodologia: Analisi giuridico-normativa della disciplina, in rapporto al contesto emergenziale e alla disciplina generale dei trattamenti di integrazione salariale. Risultati: L’indagine evidenzia il tratto emergenziale dell’intervento escludendone valenze riformatrici. Limiti e implicazioni: L’indagine sconta la provvisorietà e l’incertezza sui tempi dell’intervento e al contempo evidenzia esigenze di approfondimento sui temi della tutela del lavoro autonomo e della perdurante valenza distintiva tra previdenza e assistenza del criterio del finanziamento. Originalità: È un tentativo di lettura dell’intervento in chiave sistematica e non solo esegetica.

Guido Canavesi The specialty of the “Covid-19 emergency” social safety nets: emergency intervention or new protection model?
Purpose: The essay analyzes social safety nets during working relationship in order to identify their structural features and, in perspective, their “reforming” potential. Methodology: Legal-regulatory analysis of the legislation, in relation to the emergency context and the general framework of wage integration treatments. Findings: The research highlights the emergency aspect of the intervention, excluding its reforming values. Limitations and implications: The research deals with the temporariness and uncertainty about the timing of the intervention and at the same time highlights the need for deeper investigation on the issues of protection of self-employment and the persistent appropriateness of the financial criterion to distinguish between social security and social assistance. Originality: It is an attempt to analyze the intervention in a systematic and not just exegetical key.
