JUAN ESCRIBANO GUTIERRÈZ Il lavoro non retribuito nella giurisprudenza della Corte di giustizia dell’Unione Europea

Obiettivi: determinare la nozione di lavoratore nella giurisprudenza della Corte di Giustizia dell’Unione Europea. Metodologia: vengono analizzate le più recenti sentenze della Corte di Giustizia che hanno tentato di operare tale delimitazione. Risultati: Si rileva una concezione più restrittiva rispetto a quella usuale negli ordinamenti nazionali a causa dell’utilizzo di un concetto di proprietà legato al beneficio economico ottenuto dall’impresa e di un concetto molto restrittivo di remunerazione. Limiti e implicazioni: il diritto comunitario è ancora lontano dal creare una concezione unitaria di lavoratore. Originalità: copre un importante deficit nello studio del concetto di lavoratore in una prospettiva comunitaria. Tradizionalmente, gli studi che si sono occupati di questo argomento si sono concentrati sull’analisi delle note di dipendenza e di dipendenza.

Objectives: to determine the concept of worker in the case law of the Court of Justice of the European Union and to verify the significance of the note on remuneration. Methodology: the most recent judgments of the Court of Justice that have attempted to make such a delimitation are analysed. Results: A more restrictive conception than is usual in national legal systems can be seen because of the use of a concept of ownership related to the economic benefit obtained by the company and a very restrictive concept of remuneration. Limits and implications: Community law is still far from creating a unitary concept of worker. Originality: covers an important deficit in the study of the concept of worker from a community perspective. Traditionally, the studies that have dealt with this subject have focused on the analysis of the notes of dependence and dependence.
