Attraverso il presente studio l’A. fornisce un contributo de jure condendo per la razionalizzazione e la semplificazione delle tipologie contrattuali, proponendo l’introduzione della fattispecie del lavoro autonomo economicamente dipendente, da non ricondurre all’alveo della subordinazione, né al falso lavoro autonomo. Vengono descritte le soluzioni adottate in Spagna, Francia e Germania per disciplinare il lavoro di chi opera in dipendenza economica, ma non in posizione di subordinazione, con un approccio basato sulla nozione di relazioni personali di lavoro in cui viene considerata la persona a prescindere dalla qualificazione in termini di subordinazione o autonomia. In ottemperanza alle esigenze produttive di un sistema economico che esige prestazioni di lavoro autonomo fortemente integrate con l’impresa, viene quindi proposto – attraverso gli strumenti della comparazione – un metodo per individuare la dipendenza economica. Definita la fattispecie, vengono poi delineate una serie di tutele a favore di chi presta lavoro autonomo economicamente dipendente, tra cui una strategia di flexicurity per i lavoratori autonomi economicamente dipendenti che dovessero rimanere inoccupati.


Adalberto Perulli Jobs Act and Self-employment: Towards A New Regulation of Economic Dependence

Following an examination of current legislation, the present paper argues in favour of the reduction and the simplification of the employment contracts already in force in Italy. To this end, a proposal is put forward concerning the introduction of “economically dependent self-employment”, a new working arrangement that does not fall under the rubric of dependent work strictly speaking nor under that of bogus self-employment. In this connection, an overview is provided of the initiatives concerning economically dependent self-employment in Spain, France, and Germany to compare and contrast the regulation of the economically dependent workers who are not engaged in self-employment. The approach adopted in these countries focuses on the notion of “personal labour relations”, where emphasis is given on individuals irrespective of their employment status (salaried employees or self-employed). By means of comparative analysis and because of the pressure on production on the part of the current economic system, a proposal is made to assess the economic dependence of the self-employed, in order to meet the need to better integrate their activity into the company. The definition of this new form of employment is followed by a description of a set of safeguards for the economically dependent self-employed, which include the provision of flexicurity for those who are unemployed.
