Lara Giovanna Bertoncello Pericolo sismico e sicurezza sul lavoro: un rischio da “valutare”
L’A. analizza, tanto nei suoi aspetti squisitamente giuridici quanto nella applicazione pratica, come si colloca l’evento sismico nell’ambito degli adempimenti del datore di lavoro connessi alla valutazione di tutti i rischi per la sicurezza e la salute dei lavoratori nonché alla redazione del relativo documento di valutazione dei rischi (DVR), come espressamente previsto dal d.lgs. n. 81/2008 e successive modificazioni. La disamina prende le mosse dalle recenti cronache sui tragici accadimenti legati a fenomeni sismici per ripercorrere l’evoluzione storica della normativa in materia, mettendo in risalto tracce “giuridiche” di regolazione del fenomeno, tanto nel corpus legislativo “generale” a tutela della salute e sicurezza nei luoghi di lavoro, quanto nelle aree “speciali” del diritto delle costruzioni e della normativa antisismica. Analizzati anche la natura giuridica, la funzione e il contenuto del DVR con riferimento al rischio derivante dal sisma, l’indagine mette in risalto come si pone l’evento terremoto, nella prospettiva dell’imprenditore e degli altri soggetti a diverso titolo coinvolti, sotto il profilo delle responsabilità, sul piano civile e penale, a fronte del verificarsi di un evento infortunistico.
Lara Giovanna Bertoncello Seismic Hazard and Safety in the Workplace: a Risk to “Evaluate”
The A. analyzes, in its purely legal aspects and in practice, how the earthquake takes part of the obligations of the employer related to the assessment of all the risks to workers’ safety and health as well as to the drafting of the hazard assessment document (so-called DVR), as expressly provided by the Legislative Decree no. 81/2008 and subsequent amendments. The examination starts from the recent news about the tragic events linked to seismic phenomena to trace the historical evolution of the legislation, highlighting the “legal” marks of this matter, both in the corpus of the “general” law to protect health and safety in the workplace, as well as in the areas of the “special” law of buildings and seismic regulations. The A. also analyzes the legal nature, the function and the content of the DVR with reference to the risk arising from the earthquake and highlights how an earthquake is placed in the perspective of the entrepreneur and the other entities involved in different ways in terms of responsibility, in the occurrence of an accidents.
