Quello dei rapporti tra legge ed autonomia collettiva nella regolazione dei rapporti di lavoro è uno dei problemi centrali del diritto sindacale e in generale dell’assetto ordinamentale almeno per quanto riguarda il lavoro. Nell’analizzare le deviazioni che, nel tempo e nel mercato globale, hanno subito le regole classiche che governano questi rapporti – inderogabilità in peius della legge da parte del contratto collettivo e sua derogabilità in melius – il saggio sottolinea come l’esigenza di flessibilizzazione della disciplina del rapporto di lavoro, prima soddisfatta attraverso l’attribuzione di ampi poteri derogatori ai contratti collettivi, è oggi soddisfatta direttamente dal legislatore attraverso la complessiva riforma nota con il nome di Jobs Act. Di qui, tra l’altro, il problema dell’attuale sopravvivenza o meno nel sistema dell’art. 8 della l. n. 148/2011, sulla c.d. contrattazione di prossimità, cui in un primo tempo il legislatore aveva commesso il compito di far fronte a quella esigenza. Restano ancora ampi rinvii alla contrattazione collettiva, ma più che in funzione derogatoria, in funzione integrativa-adattativa del precetto legale, secondo l’originaria impostazione del rapporto tra legge e contratto collettivo.

The relationship between statute and collective autonomy in regulating employment contracts is one of the key issues in trade union law and in the Italian legal system in general, at least with regard to work. In analysing the changes that the traditional rules governing this relationship – in peius inderogability of the legal regime on the part of the collective agreement and its derogability in melius – have undergone in a period of greater market globalisation the article highlights how the need for more flexible rules regulating the employment relationship, initially met by allowing collective agreements wide powers to derogate, is now met directly by the legislator through the broad-ranging reform known as the Jobs Act. Furthermore it discusses the continued survival of art. 8 of law no. 148 of 2011 regulating local- and company-level bargaining, which the legislator had previously assigned the task of dealing with this need. The scope of collective bargaining remains wide, though not so much in its function of derogating from statutory provisions, but rather as a means of supplementing/adapting them, on the basis of the original structure of the relationship between statute and collective agreements.
