Debora Gentilini L’evoluzione dei tirocini formativi e di orientamento: rapporto con il contratto di apprendistato

Il saggio analizza la disciplina dei tirocini formativi e di orientamento così come regolamentati dalle Linee guida in materia di tirocini extracurricolari del 25 maggio 2017, che aggiornano e sostituiscono le precedenti del 23 gennaio 2013 emanate in attuazione della legge n. 92/2012. Nella prima parte del saggio si analizza l’evoluzione del quadro normativo in materia di tirocini a partire dalla legge n. 196/1997 fino alla recenti linee-guida in materia di tirocini del 25 maggio 2017. Nella seconda parte si analizza il rapporto tra i tirocini e il contratto di apprendistato per metterne in evidenza le caratteristiche e le modalità operative e allo stesso tempo sottolinearne il valore come strumenti per l’integrazione tra sistema educativo e il mondo della produzione. L’analisi comparata dei due dispositivi per l’alternanza scuola-lavoro è stata condotta sulla base di alcune categorie di valutazione al fine di evidenziarne analogie e differenze, nonché i principali punti di forza e criticità.


Debora Gentilini The evolution of traineeships: relationship with the apprenticeship contract

This paper analyses the legal framework of the traineeships as regulated by the recent "Guidelines on extracurricolar traineeships" of 25 May 2017 that update and replace the previous ones of 23 January 2013, issued in implementation of Law no. 92/2012 (c.d. Fornero law). The first part of the paper is focused on the evolution of the regulatory framework regarding the traineeships starting with art. 18 of law no. 196/1997 up to the recent Guidelines on traineeships of 25 may 2017. In the second part the paper analyzes the relationship between traineeships and apprenticeships in order to highlight their features and operational procedures, emphasizing their value as tools for linking the education system with the world of production. The comparative analysis of the two tools is presented taking into account certain categories of evaluation in order to highlight similarities and differences of both tools examined as well as the main strengths and weaknesses.
