Lo studio si concentra sulle due tradizionali vie esistenti nell’ordinamento giuridico spagnolo per l’acquisizione dell’esperienza pratica richiesta ai giovani per accedere ad un posto di lavoro: le borse di studio e i tirocini. Di entrambi viene, poi, analizzato in maniera esaustiva il regime giuridico rispettivamente applicabile. Da ultimo, presentando entrambe le figure confini poco nitidi con il rapporto di lavoro, tanto da essere spesso utilizzati per mascherare la reale natura del rapporto, l’articolo termina con un esame dei criteri offerti dalla giurisprudenza per tracciare i confini tra le stesse.

The study focuses on the two main ways in the Spanish legal system for acquiring the practical experience demanded of young people to access a job: scholarships and "non-work" practices. Next, the legal regime applicable to them is thoroughly analyzed. Finally, when both figures present unclear boundaries with the employment relationship, and sometimes serve to hide the true nature of the relationship, the article ends with the examination of the criteria given by the judges for their delimitation.
