Le metamorfosi del tempo di lavoro
Obiettivi: il contributo si propone di rileggere il concetto del tempo di lavoro nell’epoca delle moderne forme di lavoro per obiettivi, simboleggiate dal lavoro agile e dal lavoro su piattaforma. Metodologia: le trasformazioni del lavoro sono analizzate in chiave giuridica con l’interpretazione del dato normativo e una riflessione intorno alle tradizionali categorie civilistiche. Risultati: è ribadita la centralità del tempo di lavoro anche nel moderno mercato del lavoro, non solo come criterio di misurazione della prestazione lavorativa ma anche come presidio al benessere e alla salute e sicurezza dei lavoratori. Limiti e implicazioni: nel definire il lavoro agile come lavoro senza luogo né tempo, suggerendo anche un nuovo modo di regolare il diritto alla disconnessione l’A. esclude anche l’interesse del giurista all’organizzazione del lavoro per obiettivi. Originalità: il contributo rilegge il lavoro per obiettivi anche attraverso le nozioni di obbligazione di mezzi e obbligazione di risultati, ipotizzando un’indebita alterazione della nozione di adempimento diligente.

The Metamorphosis of Working Time
Objectives: the essay aims to reinterpret the concept of working time in face of new forms of management by objectives, namely agile work and platform work. Methodology: the transformations of work are analysed from a juridical point of view through the interpretation of normative data and a reflection on traditional civil law categories. Results: the centrality of working time in the modern labour market is reaffirmed, not only as a criterion for measuring work performance but also as a safeguard for the welfare, health and safety of workers. Limits and implications: in defining agile work as a work without place or time, also suggesting a new way of regulation the right to disconnection the A. also excludes the interest of the jurists in the organization of work by objectives. Originality: the contribution re-reads the work by objectives also through the notions of obligation of means and obligation of results, assuming an undue alteration of the notion of diligent performance.
