Stefania Battistelli Legittimità e criticità delle esternalizzazioni in Italia: il caso dell’industria delle carni

Obiettivi: Il saggio esamina alcuni fenomeni distorsivi generati dall’ampio ricorso a forme di esternalizzazione produttiva nel settore delle carni, con uno sguardo propositivo rispetto ad alcune problematiche che emergono dall’attuale quadro normativo. Metodologia: La ricerca è basata sia sull’analisi del quadro giuridico-normativo italiano e della documentazione in materia (accordi sindacali, vertenze, relazioni ispettive) sia su alcune interviste a testimoni privilegiati quali avvocati del lavoro, funzionari sindacali, operatori Asl, magistrati, assessori e membri di Commissioni di certificazione. Risultati: Nonostante le numerose criticità che si annidano all’interno del settore delle carni, sono molteplici gli interventi migliorativi che potrebbero essere adottati, sul piano legale e contrattuale, per prevenirle. Limiti e implicazioni: Il saggio consente di studiare l’outsourcing attraverso l’analisi di uno studio di caso emblematico degli effetti di tale fenomeno sui reali processi produttivi. Originalità: Il saggio analizza un settore ancora poco studiato e approfondito nelle scienze giuridiche attuali.

Stefania Battistelli Legitimacy and Criticality of Outsourcing in Italy: the Case of Meat Industry

Objectives: The essay aims to examine some distorting phenomena that arise from the adoption of an outsourcing model in the meat industry, with a proactive focus on some issues regarding the current legislative framework. Methodology: The research has been carried out through a combination of desk and field research. The desk research is mainly based on the analysis of the Italian legislative framework and of some documentation (i.e. trade union agreements, litigations, inspection reports). The field research is based on interviews of stakeholders such as labour lawyers, unions and employers’ organizations, as well as a judge in a Criminal Court, National Health Service members, a counsellor for legality and members of Certification Commissions. Results: In spite of the many critical issues that concern the meat sector, it is possible to adopt various legal and contractual measures in order to solve them. Limits and implications: The essay sheds some light on outsourcing through the analysis of a case study which is emblematic of the effects of this phenomenon on real production processes. Originality: The essay analyzes a sector which has been poorly researched and deepened in the legal science so far.
