Juan Escribano Gutiérrez Lavoro e ambiente: le prospettive giuslavoristiche

Muovendo dalla necessità di affrontare l’impatto delle attività umane sull’ambiente esterno, l’A. affronta il tema della tutela ambientale dal punto di vista giuslavoristico. Nella prima parte del saggio, la logica concorrenziale capitalistica è individuata dall’A. come la causa principale dell’erronea dicotomia tra lavoro e ambiente, che ridotti a meri strumenti di produzione competono inevitabilmente l’uno contro l’altro. La seconda parte del saggio si concentra sulla normativa giuslavoristica spagnola, che tende a distinguere il piano della prevenzione della salute sul posto di lavoro da quello della salvaguardia ambientale, contribuendo ad accentuare la contrapposizione tra le due realtà. Sebbene l’ultimo decennio abbia visto l’ingresso delle questioni ambientali nell’agenda delle autorità pubbliche e delle organizzazioni sindacali, gli impegni effettivamente assunti in questo ambito sono stati scarsi. L’A. conclude esplicitando la necessità di uniformare la legislazione nazionale a tutela della prevenzione dei rischi sul luogo di lavoro con quella relativa alla salvaguardia ambientale. Un maggior coinvolgimento dei lavoratori si rende infine necessario per superare l’erronea percezione circa la presunta incompatibilità tra lavoro e ambiente.


Juan Escribano Gutiérrez Work and Environment: Perspectives on Labour Law

After contending the need to evaluate the effects of human activities on the external environment, the A. deals with environmental protection from the perspective on labour law. In the first part of the essay, the competitive logics of capitalism are identified by the A. as the main rationale behind the wrong dichotomy between work and environment, which are both intended as mere production factors ending up involved in a dangerous competition against each other. The second part of this essay focuses on the Spanish legislation, where norms aimed at preventing risks at work-place are rigorously separated from those guaranteeing the environmental protection, thus exacerbating the contraposition between the two spheres. Moreover, even though environmental issues have been recently included in the agenda of public authorities and workers’ representatives, the commitments made therein have been scarcely effective. The A. concludes stressing the urgency to align the legislation on health and safety at workplace with the norms focused on environmental protection. Workers’ involvement is finally promoted in order to overcome the erroneous perception of work and environment as conflicting realities.
